| Bhim Singh hails initial verdict of ICJ on jurisdiction in Kulbhushan Jadhav case | |
Jammu, May 18, (Scoop News)-Prof.Bhim Singh, Sr.Executive Member, Supreme Court Bar Association of India and expert on International Law and ICJ today welcomed the interim verdict of the International Court of Justice at Hague in which the ICJ rejected Pakistan’s arguments challenging the jurisdiction of the ICJ in Jadhav’s case.
Prof.Bhim Singh, a Barrister-at-Law and Postgraduate from London University who appeared in the ICJ in the seventies hailed the verdict of the ICJ this afternoon which the full bench of 11-judges delivered from the Hague seat of the court rejecting Pakistan’s objection to India’s petition it filed before the ICJ. The ICJ verdict on its jurisdiction within the meaning of Section 42 of Vienna Convention and 36 of the Charter of the United Nations, the court made it clear and specific that it enjoys full power to entertain this petition filed by India on behalf of the Indian prisoner namely, Kulbhushan Jadhav who is facing death sentence in Pakistan which was delivered by a military court of Pakistan.
President of International Court of Justice Ronny Abraham said, "International justice is a long-drawn-out affair. Its establishment is an ongoing and gradual process, and always a difficult one. In practice, it is an ideal we seek to attain but where much still remains to be done. We must avoid excessive idealism and naivety, but also too much cynicism. The last few decades have shown that international justice has made genuine progress. On the other hand we must not believe that the stage has been reached where all the major political issues facing the world can be settled in the courts."
Prof.Bhim Singh had written a letter on 12th April, 2017 to the Supreme Court of Pakistan with a copy of a petition against Jadhav’s death sentence. Prof.Bhim Singh had also declared that he shall move International Court of Justice, if need be or in case Pakistan did not accept his petition challenging Jadhav’s death sentence.
The ICJ ruling also made it mandatory that pending the meeting of the court Pakistan shall not implement its order passed against Mr. Kulbhushan Jadhav. In the meantime, Pakistan had made it clear the time of arguments that Pakistan is not going to implement the order of the court martial before August this year.
Prof.Bhim Singh said that he shall go to the Hague next month to assist the ICJ in Kulbushan Jadhav on behalf of the Legal Aid Committee in the month of June this year.
