JKRCEA castigates state govt. for silence over reservation; threatens agitation

Jammu, January 11, (Scoop News)- Castigating the Jammu & Kashmir State govt. for silence over issue of reservation in promotions, the leaders of socio-religious, retired employees forum, unemployed youth/students and women wings of Jammu Kashmir Reserved Categories Empowerment Alliance (JKRCEA), in press conference held here today, have threatened to start mass agitation if the coalition govt. failed to resolve their issues. While talking to the media persons, the heads of various wings of JKRCEA have said that they unitedly stand for SC/ST/OBC communities of J&K whose population is approximately 35-40 lac and in one voice condemned the non-responsiveness of coalition govt. in defending its position on the issue of RESERVATION IN PROMOTION in scores of writ petitions’ relating to issue of reservation in promotion in the high court of J&K and Apex court of the country.

Bod Raj Bhagat, President, socio-religious wing of JKRCEA said that the division bench of J&K high court on 09.10.2015 had struck down provisions of Reservation in Promotions where the state govt. was itself a party. The gravity of matter is that the government preferred not to file SLP in Apex court and when the private respondents belonging to reserved categories got the impugned order stayed through SLP titled Mohammed Haneef Lone vs State & Naseeb Sing Vs State & Ors, the bureaucracy of J&K State is not implementing this stay order and affecting promotions in various department in contravention to the stay order and reservation law, added Bhagat. He also informed that the interim orders of the Apex court were not only misinterpreted deliberately in favour of upper caste employees but throwing these orders to wind which testimonies that the coalition govt. has caused worst ever irreversible damage to the employees of scheduled castes, scheduled tribes and other categories. Citing an example, he pointed out that in Power development department; the juniors have been picked up and promoted as Chief Engineers ignoring the senior and in whose favour the stay by apex court was granted which put a big question mark on the good governance and implementation of natural law of justice as claimed by the govt.

R.C.Bhasin of retired employees wing of JKRCEA appealed the Chief Minister Ms. Mehabboba Mufti to intervene into this very sensitive & serious matter and bring suitable ordinance/resolution/bill/amendment in the current session of the assembly to resolve the issue once forever. He also stressed upon the government to adopt Constitutional 77th, 81st & 85th amendments. Government should also set up a committee including members of Civil society from SC/ST/OBC’s, Socio-religious heads of SC/ST/OBC organizations as well as elected representatives of SC/ST/OBC to work up the quantifiable data that will show how much reservation have been given & implemented in J&K. Chief Minister is also requested to immediately call meeting of ENFORCEMENT BORAD ON MONITORING & IMPLEMENTATION OF RESERVATION IN J&K, she being Chairman of said Board.

Talib Choudhary, leader of youth wing of JKRCEA stressed upon the government to immediately come up with political solution to this very sensitive sociopolitical issue in the ongoing session of state assembly He warned that these communities would be left with no other option than to come on road if callous attitude of government continues in the matter. He appealed for large scale social unity amongst SC, ST, OBC’s for sustained struggle.
M.R.Bangotra said that successive governments of J&K State are responsible for not adopting the 77th, 81st & 85th Amendments of Indian Constitution. He requested the Chief Minister to call for Cabinet meeting and adopt the said amendments to negate the high court verdict. He further added that to get restoration of reservation in promotions reserved categories can go up to any extent as Reservation of any kind is constitutional right of these communities. He further warned the government that if government fails to come up with viable & just solution of the issues, they would launch mass agitation. He further said that few bureaucrats are illegally promoting employees ignoring Supreme court Order, these babus need to be carved adequately to avoid any crisis/unrest amongst the masses.
Abdul Majid Malik & Prof Kali Dass representing All India Backward Classes Union advised the government to act quickly on otherwise sensitive issue before the reserved category people constituting about 60% population become unrest and take some drastic steps that shall not be in the larger interest of the government of the day. They also demanded that Enforcement Board meeting on monitoring & implementation of reservation as per Reservation act should be convened immediately under the chairmanship of Chief Minister calling intellectuals from civil society to come out with exact data how much reservation has been implemented and what are the areas that require further attention of the government.

Nighat Shafeeq Student leader while lambasting upon the government said that a huge number of cases atrocities on SC/ST/OBCs, harassment of gujjar and bakerwal and violation of reservation rules in direct recruitments and promotions have seen in current regime which gives a clear message that the coalition govt. is anti-SC/ST/OBC. She advised the government to immediately take necessary steps to protect the constitutional rights of these communities so that they should not feel alienated any more.
