To what extent is J&K Govt involved in Ashifa Bano’s rape and murder?

It is sad that in a state where “rape” was mostly unheard of, in a state where the major languages do not even have an equivalent of the term “rape”, we are witnessing a day where an innocent girl child is brutalised in order to “instill fear” among a community! Despite J&K CM Mehbooba Mufti’s hollow assurances, the J&K govt is not doing enough to bring to justice the culprits who were involved in the rape and murder of the innocent child, Ashifa Bano. In fact, the level to which state actors are involved in the case is shocking, to say the least.

1) On whose order was SPO Deepak acting? He has reportedly said to the Crime Branch that he wanted to “strike terror among the hearts of the nomadic community.” Why did he want to do so? Why was he acting politically? Is he affiliated to Hindu Ekta Manch or BJP?

2) It was also found that another SPO was aiding Deepak Khajuria. It is a miracle that two SPOs have been arrested at all, but that is because of the protests by people. It is not as if the government would have made arrests in the absence of protests.

3) Next, the district administration and J&K Police allowed and escorted the pro-rape rally carried out in support of Deepak Khajuria, whereas those who protested against the rape incident were put down with violence. Generally speaking, even teachers who are demanding economic rights are not allowed to protest. When MNREGA workers tried to protest in Jammu a few months ago, they weren’t allowed. Then, how was a pro-rape rally allowed?

4) Leaders of the BJP - which is part of the ruling establishment in J&K - were present in the rally. Why is there no action by the state government against these pro-rape protestors? The people who were involved in the rally should be booked for unlawful assembly, abetting crime as they have threatened violence, and violation of the Flag Code. What is the point of having a female Chief Minister if she can’t even take action against pro-rape protesters? If she doesn’t take action, the public will be forced to conclude that the state government is complicit.

5) Coalition partner BJP - under the garb of Hindu Ekta Manch - is trying to get SPO Deepak Khajuria released because he will probably expose other actors involved in the conspiracy. Also, such mobilisations will deter the state administration from making further arrests. This has all the elements of a political conspiracy.

The judiciary should investigate the extent to which the state government is involved in the gruesome incident.
