Union Govt. led by Modi exposed on its hidden agenda vis-à-vis J&K

New Delhi, May 15, (Scoop News)- Prof.Bhim Singh, Sr. Advocate & Executive Chairman of State Legal Aid Committee, J&K expressed no surprise on the stand taken by the Union Govt. before the Supreme Court of India regarding the constitutional status vested in the Govt. of J&K vis-à-vis Fundamental Rights. The Union Govt. through its counsel before the Supreme Court expressed that the Govt. of India would not like to file any counter affidavit before the Supreme Court in the writ petitions challenging the constitutional validity of Article 35(A). Article 35(A) was inserted in the Constitution of India by an Ordinance of the President in 1954 within the scope of Article 370 which empowers only the President of India to amend any provision in Article 370 relating to the constitutional status to J&K guaranteed in the Constitution of India.
Prof.Bhim Singh said that BJP and offshoot of Jan Sangh had a commitment to remove Article 370 from the pages of the Constitution of India. The BJP has been exposed without any reservation that it shall follow the dictates of Article 370 without even daring to amend it. The BJP has been exposed that the writ petitions challenging the validity of Article 370/Article 35(A) have not been supported or backed by the BJP Govt. at the Centre.
The counsel for the government has submitted that the Central Govt. shall not file any counter affidavit and argue the case. It did not say what was the stand of the Union Govt. in this regard.
Prof.Bhim Singh declared that the Panthers Party shall file a writ petition seeking amendment in Article 370 and removal of ‘A’ from the bottom of Article 35 of the Constitution of India. Prof.Bhim Singh said that Article 35(A) deprives the citizens of India in J&K of their Fundamental Rights at the will of the State Assembly/State leaders. Article 35(A) was inserted in the Constitution of J&K only to enslave the citizens of India in J&K so that they could be deprived of their Fundamental Rights enshrined in Chapter-III of the Constitution of India. It was Article 35(A) which has been used like a sword by the rulers of J&K to crush the Fundamental Rights enshrined in the Constitution of India but were not allowed to be implemented in J&K. It was Article 35(A) which made state government in J&K powerful to imprison even the Prime Ministers and later Chief Ministers of J&K. Hundreds of political leaders have suffered detentions without trial for years. Prof.Bhim Singh said that he himself spent more eight years in jails under the detention laws because Fundamental Rights are not available to the citizens of India called Permanent Residents of J&K.
Prof.Bhim Singh congratulated the people of Karnataka for teaching a lesson to Modi-led BJP government in Karnataka Assembly polls. He hoped that all political parties shall learn similar lessons in future.
