India trashes OHCHR report, apparently a facsimile copy of an earlier OIC resolution
subverts UN led global accord on zero tolerance to terrorism




Jammu, June 17, (Scoop News)-Over three years ago, Organisation of Islamic Cooperation (OIC) held a meeting in one of the Central Asian countries where high Commissioner for human rights, Zeid Ra’ad AL Hassan, was the chief guest. During the meeting, the OIC adopted a resolution which is the exactly the same in content as report put forth by the office of the United Human Rights High Commissioner for Human Rights (OHCHR) on human rights violations in Jammu and Kashmir.

In India, the 49 page controversial report has been vociferously negated by one and all irrespective of their political affiliations. Reports even suggest that OHCHR had sent an advance copy to Indian authorities on June 4 to point out factual corrections.

Zeid, a known lobbyist for the Muslim cause, has not cited any resolution of the United Nations General Assembly (UNGA) or the United Nations Security Council (UNSC) for his endorsement.

Lodging a strong objection on the lopsided report, India in a communication sent to his office on June 12, charged OHCHR for its deviation from the internationally acknowledged terminology in the report. Zeid, incidentally didn’t make any corrections in his report in spite of India’s strong objection.

Notwithstanding UNSC resolution 1267, the report has used UNSC embargoed terrorist organizations Lashkar e Tyyaba (LeT) and Jaish e Mohammad (JeM) had been portrayed as armed groups 38 times. The report has referred to terrorists as leaders of these groups. Surprisingly, the report also subverts the UN led global accord on zero tolerance to terrorism.

Again, Pakistan occupied Kashmir (PoK) has been depicted as Azad Jammu and Kashmir as many as 26 times in the controversial report. To call Kashmir, UN uses the universally accepted terminology: Indian Administered Kashmir or Pakistan Administered Kashmir and not Azad Jammu and Kashmir. This terminology had been earlier used in the OIC resolution.

According to the sources, the report which is titled “Report on the situation of Human Rights in Kashmir, Developments in the Indian State of Jammu and Kashmir from June 2016 to April 2018 and General Human Rights Concerns in Azad Jammu and Kashmir and Gilgit- Baltistan” takes a specific period of turmoil in the last two years and depicts a biased picture of the situation.

Zeid has not taken the cognizance of India’s reply of June 12 and did not mention cross border terrorism even once and has only alluded to cross border shelling on two occasions in the report on the situation, the sources said.

Defending its case, the sources said India referred to UN resolution 48/ 141 states that the High Commissioner for Human Rights should respect the sovereignty and territorial integrity of member countries. But by using terms like Azad Kashmir and Gilgit Baltistan, well informed sources said that he has violated the resolution of as India considers them to be an integral part of the country.

Zeid, who is due to retire on August 31, has represented his own views in the report and doesn’t reflect the views of the UN Human Rights Council as an institution. “It is neither a UN report nor the report of the office of the High Commissioner, which is different. We must distinguish between the two,” they said adding that he apparently wanted seek attention in the coming session of UNHRC and also make his last blazon before leaving the post.

The sources said he has not consulted any of the member countries and appears to be driven by a personal agenda. The tainted official has openly contravened all norms of the multilateral participations, they said.

On no occasion, has the Council had authorized or approved Zeid to undertake any surveillance as he has acted alone, without any approval from UNHCR, the sources said.

India has also informed OHCHR that the people of Jammu and Kashmir have borne the major brunt of cross border terrorism from the Pakistan state for last three decades,. Since 1990 ‘s India has lost 14,000 innocent civilians and over 5,000 security men to cross border terrorism in Jammu and Kashmir, the sources said.

India’s human rights record was evaluated in May 2017 as the Universal Periodic Review (UPR) at the Human Rights Council where all member countries had carried out an assessment, the sources maintained. At that point in time, all member countries had freely given suggestions and recommendations on various aspects and all member countries except one supported of India, they added. ...
