Prof. Bhim Singh welcomes rejection of petition seeking revival of State Assembly
Srinagar, December 10 ((Scoop News)- Prof. Bhim Singh, Executive Chairman of State Legal Aid Committee & Sr. Advocate in the Supreme Court has welcomed the decision of the Supreme Court of India rejecting a writ petition filed by an MLA of dissolved Assembly today.

Prof. Bhim Singh was present in the Supreme Court today when this matter came for hearing. He said that the petitioner a member of the dismissed Assembly had no case because Jammu & Kashmir has a separate Constitution and the Governor in J&K has power vested in him to dissolve the Assembly under J&K Constitution. The petitioner had cited some Supreme Court cases in his support but the BJP MLA should have known that J&K has separate Constitution and Governor has absolute power to Act. The Governor’s in other states do not have such power.

Prof. Bhim Singh said that this decision of the Supreme Court has boosted the political morale of the people in J&K and the BJP leadership has been exposed. All other political parties which were seeking share in the power have also been exposed. The National Conference, PDP & the Congress has been exposed before the people in J&K and elsewhere also.

Prof. Bhim Singh hoped that the Governor, Shri Satya Pal Malik must show his courage and commitment to appoint Delimitation Commission at the earliest before going for Assembly polls. The SC in a earlier case filled by the Panthers Party had made it clear that the Govt. of Jammu & Kashmir can hold Delimitation of the Constituencies in J&K which has not been held since 1995. This is also in the interest of civil & political rights of the Scheduled Tribes like Gujjars – Bakerwals & Gaddies etc. who have not been provided Constitutional reservation since they were brought under ST Category in J&K.
