| President’s rule certain after Dec 20, MHA seeking assent of Union cabinet for its imposition in JK | |
Jammu, December 13, (Scoop News)-After 28 years the President’s rule will be once again imposed in Jammu and Kashmir when the Governor’s rule comes to end on December 19th . Under state’s own Constitution, the Governor’s rule cannot be extended beyond six months period.
Under Article 92, Section (5) of the Jammu and Kashmir Constitution “No proclamation under sub section (1) shall be issued except with the concurrence of the President of India.”
Contrary to other states in India, imposition of President’s rule to Jammu and Kashmir is more subtle where the Governor’s rule for first six months is constitutionally permitted,
The Governor, Satya Pal Malik, is all set to recommend Centre’s rule in Jammu and Kashmir from December 20th onwards to the Union Ministry of Home Affairs (MHA).
The state had been put under Governor’s rule after Bhartiya Janta Party (BJP) pulled out of the coalition with Mehbooba Mufti led Peoples Democratic Party (PDP) on June 19th was placed under the Governor’s rule.
Well informed sources told Scoop News that officials in the MHA will soon seek assent from the Union Cabinet for President’s in the state and the same has be got ratified by the both houses of the parliament.
The President’s rule will be in force for next six months. They said.
During President’s rule, the parliament will be making laws on the 67 subjects on the state’s list, the sources said.
Interestingly, the money bill which would been approved and adopted by the parliament was, however, put into the motion by the Governor’s administration by holding pre budget discussions with various departments,, Public Sector Undertakings, Traders and other concerned organizations. The exercise is nearing completion now.
