Foreign dignitaries enjoying tourism in Kashmir, political activists are in jail:Bhim

Jammu, February 12 (Scoop News)-Prof.Bhim Singh, Chief Patron of National Panthers Party in an urgent appeal to Mr. Ramnath Kovind, the President of India urged for immediate intervention to ensure prompt release of hundreds of political prisoners in Kashmir Valley who have been sulking in jails and inside their own houses in Kashmir and in other places in the country under the nefarious dead Law called J&K Public Safety Act, 1978.

NPP Supremo, a Sr. Advocate in the Supreme Court held a meeting of several lawyers involved in State Legal Aid Committee, J&K and took a joint decision to file an urgent writ petition in the Supreme Court of India under Article 32 of the Indian Constitution for the immediate release of all those who have completed more than three months in custody in Jammu and Kashmir under so-called Public Safety Act (PSA). He urged the President of India to send a committee of senior bureaucrats including lawyers to collect the information regarding the horrifying detentions of senior political leaders including three former Chief Ministers of J&K, one of them Dr. Farooq Abdullah, a sitting Member of Parliament (Lok Sabha) who has not been allowed to attend the Parliament in two Parliamentary Sessions in the past six months.

Prof.Bhim Singh urged the President to seek the opinion of the Attorney-General of India on the question vires/constitutional validity of the so-called Public Safety Act, J&K which was enacted by the J&K Assembly in 1978 because at that time J&K Assembly was empowered to make any Law like PSA in Jammu and Kashmir even if violated the fundamental rights enshrined in Chapter-III of the Indian Constitution. State Legal Aid Committee has authorized Prof.Bhim Singh to move the Supreme Court of India without any delay seeking urgent release of all the detenus in Jammu and Kashmir who have completed more six months under the so-called Public Safety Act. It was also urged that President may be requested to direct the administration of J&K to release appropriate compensation to all those who have been detained for more than three months under PSA in J&K.

Prof.Bhim Singh said that the President is the only hope that the fundamental rights enshrined in Constitution of India in its Chapter-III shall be applicable to all the residents of J&K including Kashmiri detenus which have been guaranteed by the Constitution of India and were fully applicable after the abrogation of Article 35-A from the Constitution of India.

Prof.Bhim Singh declared that the State Legal Aid Committee shall move the Supreme Court for immediate relief so that justice shall flow to every door in Jammu and Kashmir also. He said inviting foreign dignitaries to Kashmir and hoasting them special dinners and feasts and Dul Lake shikara facilities shall not satisfy the people of J&K who deserve justice, application of rule of law and delivery of all fundamental rights which have no become applicable in Jammu and Kashmir also after 70 years.
