Delhi High Court set aside life sentence against Kashmiri boys | Ordered their immediate release from Tihar Jail |
New Delhi/Jammu,May 6 (Scoop News) -Today the Division Bench comprising of JJ S.R. Bhat & S.P. Garg of Delhi High Court set aside the conviction (life sentence) of Mohd. Iqbal Jan, District President of JKNPP of District Bandipora (Kashmir). Mohd. Iqbal was awarded life sentence in 2009 by the Additional Sessions Judge, Delhi. Mohd. Jan has already spent seven years in Tihar Jail, Delhi. Mohd. Iqbal Jan was arrested by the Special Cell of Delhi Police on 27.11.2006 near Kauria Pul, Old Delhi Railway Station where he was slapped with the charges u/s. 121, 121-A, 122, 123/120-B Indian Penal Code read with Section 4 & 5 of Explosive Substance Act & section 17, 18, 20, 21, 23 of the Unlawful Activities (Prevention) Act. His case was argued by Prof. Bhim Singh, Sr. Advocate once before another Division Bench which could not deliver the judgment because of the non-cooperation of the prosecution. The case was referred to another Division Bench headed by Justice S.R. Bhat. Judgment was reserved on 28.02.2012. The High Court came to conclusion that the conviction could not be sustained and set aside the same directing the immediate release of Mohd. Iqbal Jan & Musthaq Ahmed Kaloo who was also convicted in the same case. Ms. Kamini Jaiswal, Advocate had argued the case of Kaloo. The High Court directed the release of both without any further delay. Prof. BhimSingh described the judgment as a candle light for all those prisoners who still continued to be denied justice. He said such a judgment is a great hope particularly for the Kashmiri boys facing trials in different courts of the country. Sure, justice was delayed but not denied. Gaurav Kumar Bansal, B.S.
