Accused involved in BOPEE Paper leakage Scandal convicted
Jammu, April 25, (Scoop News)- Today on 25-04-2018, the Court of Special Judge (Anti Corruption), Srinagar, after trial, involving examination and cross examination of more than hundred witnesses, arguments and counter arguments by the prosecution and battery of lawyers representing 50 accused persons convicted as many as ¬¬¬43 accused persons in case FIR No. 24/2013 of Crime Branch Kashmir. The Hon’ble Court while holding the accused guilty awarded rigorous imprisonment of 5 years with fine of Rs 1.00 Crore to Peer Mushtaq Ahmad then Chairman BOPEE, another accused Sajad Ahmad was awarded rigorous imprisonment of 5 years with fine of Rs 50.00 lacs. Other convicted accused have been awarded with rigorous imprisonment ranging from 3 years to 5 years and fine ranging between 5.00 lacs to 25 lacs.
Case FIR No. 24/2013 was registered in Police Station Crime Branch Kashmir on 24/09/2013 to investigate into the alleged paper leakage in CET Session 2013. On thorough investigation of the case it had surfaced that Mushtaq Ahmad Peer then Chairman, BOPEE had in league with Farooq Ahmad Yatoo fraudulently and dishonestly leaked the question papers of said Entrance Examination to various beneficiaries against huge monetary considerations prior to conduct of examination and a result of leakage of papers in advance the beneficiaries managed their selection among top rankers and thereby marred the career prospects of gullible students. The investigation of the case was conducted by SIT constituted by Crime Branch, which was headed by Sh Mir Aftab Alam, then Addl. SP, Crime Branch Kashmir. On the strength of evidence, oral and documentary, the investigation of the case was concluded as proved against as many as 60 persons including 09 Juveniles. Charge sheet against 50 accused persons was produced before the Court of Spl Judge(Anti Corruption), Srinagar and Charge sheet in respect of 09 Juveniles was produced in Feb, 2014 in the Juvenile Court(CJM Srinagar).
The prosecution on behalf of Crime Branch was conducted by Sh Khalid Muzaffar, Chief Prosecuting Officer who was specially appointed as Spl. Public Prosecutor by the State Govt. The DGP has appreciated the role of investigating officers of Crime Branch and the Chief Prosecuting Officer who conducted the prosecution of the case successfully.
