Republic TV served legal notice under Sections RPC 499 and IPC 500 for alleged derogatory remarks against PDP chief Mehbooba Mufti, on July 5 programme


Srinagar, July 12, (Scoop News)-Peoples Democratic Party (PDP) chief, Mehbooba Mufti, has served a legal notice to Arnab Goswami, editor in chief of Republic TV for his alleged libelous, muckraking and derogatory remarks against her.

The legal counsel, Sheikh Rizwan Javeed, has sought Arnab’s unconditional apology for his disparaging remarks and in case he fails to do so his client would be constrained to initiate both civil and criminal actions against him and the news channel as per the provisions of law.

The notice referred to a programme telecast on July 5 wherein the anchor had invited several panelists to participate in a debate over the topic highlighted through the hashtag #KashmirFightTukdeGang.

“Your statements projected my client as a dishonest person who has made fortune by deceitful means and is now spending it extravagantly. Right at the onset, my client out rightly denies these brazen allegations. My client has had an impeccable political career and never ever has faced any criticism where she has been –projected as a dishonest person,” the notice mentioned.

The notice further stated, “That as explained in the facts and circumstances herein above, the incorrect and grave allegation raised by you against my client amount to criminal defamation under Section 499 of the Ranbir Penal Code (RPC) and is punishable under the penal laws of both RPC and Indian Penal Code under Section 500. It is thus apparent that you have committed as offence of defamation for which you are liable to make good and compensate my client for the damages to her reputation that she has already suffered and which is continuous in nature.”

“Your statements on the said programme are full of lies and while even speaking you are not coherent and it clearly seems that you are making up these statements. Furthermore, the failure on your part of both you and your channel as a whole to support these claims with any proof shows the malicious intent behind these statements and further proves that your allegations against my client are baseless,” it added.

The counsel for Mehbooba demanded an unconditional public apology through print, electronic and social media for the incorrect statements made and allegations leveled against her and by broadcasting the said public apology on Republic TV with the same prominence and frequency as the impugned statements.

The notice also sought an assurance to her office, through a letter, e mail within three days from the receipt of this legal notice that Republic TV would desist from any further defamation of my client and will also ensure that you will apologise for the previous defamatory statements. ...
