| COVID-19: District Magistrate Leh imposes CrPC 144 in district | |
Leh,March 24 (Scoop News)-With the prevailing health situation due to COVID-19, District Magistrate Leh Sachin Kumar Vaishya issued an order 23/3/2020, under Section of CrPC 144 with relevant provision under the Epidemic Diseases Act, 1897 and Disaster Management Act, 2005 in relation with apprehended danger to human life, health or safety, the order reads that;
1) Whereas, the prevailing health situation due to (COVID-19) in several countries of the world including india has given rise to serious converns in inida as well; and
2) Whereas, COVID-19 has a pattern of transmission at a rapid rate in case prescribed preventive protocols, like avoiding mass gatherings etc. are not strictly followed; and
3) Whereas, section 144 of CrPC empowers the undersigned to issue certain directions/orders in urgent case of nuisances of apprehended danger when it is considered that such direction is likely to prevent danger to human life, health or safety,
4) Whereas, Epidemic Diseases act, 1897 and Disaster Management Act, 2005 also empowers the undersigned to issue certain directions for safety and preventing any harm to human life.
5) Therefore, Sachin Kumar Vaishya, District Magistrate Leh vide powers conferred upon him under Section -144 of CrPC with relevant provisions under the Epidemic Diseases Act, 1897 and Disaster Management Act, 2005 order the following w.e.f 08:00 pm on 23-03-2020 till 06:00 pm on 31-03-2020:
i) Complete restriction on movement of any type of Inter-District/Intra-District public transport, as well as vehicles bearing commercial numbers, except for SRTC buses plying on limited destination (i.e. Hanley, Koyul, Demjok, Chumathang, Nidar, Muth) and any other authorized transport for essential purposes.
ii) Private vehicles with single occupancy for essential services shall be allowed. Plying of private vehicles other than those used for essential services shall be banned.
iii) There shall be no movement of traffic from Kargil District to Leh District and vice versa. However, passengers using air Transport from Leh Airport shall be allowed only on production of Air tickets.
iv) People are directed to stay at home and come out only to procure essential commodities for consumption with the conditions mentioned at para no. 2. Assembly of any kind for demonstration, rallies, processions, protest and gathering of any kind (social/cultural/political/religious/academic/ sports) shall be completely prohibited.
v) The passengers coming out from and going to Airport shall be permitted to move on production of Air Tickets. The staffs deployed at airport shall be allowed to move on production of ID card.
vi) The essential services of following shall be exempted from the purview of this order which includes Treasury office, Labour office, Cooperative stores; supply of groceries/fresh fruits and vegetables (dealers/distributors/retailers) all petrol pumps; all dairy shops/bakery shops; supply of cattle feed/fodder/ agriculture seeds; poultry feed; Medical and pharmaceuticals shops; banks and ATMs (All sanitary precaution shall be taken care by concerned bank); supply of LPG; Health Services (Movement of ambulances, staff and supply of medicines); telecommunication and movement of concerned staff; Fire & Emergency Services; Post Offices; Airport; Fair price shops, transportation/ loading or unloading of essential commodities; provision of electricity, water supply; maintenance/repair works needed for hospital and quarantine centres; municipal and sanitary services (movement of staff); veterinary services and movement of staff.
This order shall be complied by whole of population (residents/migrants/service personnel etc.) within the territory of district Leh without any exemption.
Sr. Superintendent of Police, Addl. District Magistrate and all Sub Divisional Magistrates shall be responsible for implementation of this order in letter and spirit. However, utmost precaution shall be taken that general public should not be placed at any inconvenience.
Addl. Distt. Magistrate shall deploy Executive Magistrates within the territorial jurisdiction of tehsil Leh by dividing it into sectors. SSP Leh shall provide necessary security personnel for enforcement. At Sub Division level, all SDMs shall be the nodal officers for strict implementation for same.
Since, it is not possible to serve this order individually; it shall be circulated in print, electronic and social media for information of all concerned.
Violation of this order shall invite penal action as mandated under Section-188 of IPC as well as under section 51 of NDMA, 2005.
