Court restrains circulation of morphed video/photos of IAS Officer

Jammu, August 01 (Scoop News)- In a civil suit filed by Niraj Kumar, JK-cadre IAS officer, Chief Judicial Magistrate, Jammu has restrained Facebook Inc., Google Inc., YouTube LLC & Twitter International Company from circulating morphed video/photographs of Niraj Kumar from their platforms. Moreso, notices were sent to the Secretary, Ministry of Information and Broadcasting, Secretary, Ministry of Telecommunications, Department of Communications & J&K Chief Secretary.
As per the plaint of Niraj Kumar, ‘certain mischievous forces who were opposed to the upright, innovative reforms introduced by the Plaintiff during his posting as D.C Udhampur, cooked up a conspiracy to unnecessarily defame and denigrate the plaintiff’. “And morphed, doctored photographs as well as a video of the plaintiff were made viral through social media which created a sort of furore amongst the Netizens” thereby leading to his attachment and initiation of a full-dressed inquiry. Now that, petitioner is posted as Additional Resident Commissioner, J & K, these offending, morphed and defamatory images are creating tight corners for him.
Niraj has further canvassed the right to maintain dignity, right to live with dignity, right to preserve reputation in all facets of right to life under Article 21 of the Constitution of India. Niraj has sought a declaration to the effect that URLs generated by defendants displaying photographs/video messages referred to in the plaint, relating to or arising from, in connection with any alleged acts or behavior relatable to the plaintiff are morphed, unverified & defamatory. He has also sought ‘‘permanent injunction’ restraining not only the defendants but other persons from publishing, broadcasting, distributing or disseminating in any form whatsoever any defamatory material ―including the purported photographs/video messages referred to in the plaint, relating to or arising from, in connection with any alleged acts or behavior relatable to him. The case has further been fixed on 29-08-2020. Pertinent to mention, these photos/videos of the IAS officer had created a virtual furore on social media with stories and versions of all sorts. Now that, Court has come to the rescue of the IAS officers and restrained dissemination of these photographs.
